AI Joins the Hunt for Tax Residency Changes
In the ever-evolving landscape of tax regulation, New York and other states are deploying artificial intelligence (AI) to track down affluent remote workers who have shifted their tax residency. With the rise of remote work, many high earners have relocated from high-tax states like New York to more tax-friendly jurisdictions such as Florida and Texas. This migration has prompted tax authorities to turn to technology for assistance.
The New York State Department of Taxation and Finance has reportedly sent out hundreds of thousands of AI-generated letters, primarily targeting wealthy individuals who may need to update their tax residency status. This innovative approach aims to streamline the process and compensate for staff shortages in the department. In 2022, New York experienced a significant uptick in audits, with 771,000 cases—a 56% increase from the previous year—despite a 5% reduction in the number of auditors.
Mark Klein, a partner at Hodgson Russ LLP, explained that the tax department is utilizing sophisticated AI technology to identify the most suitable candidates for audits. The focus is on those who have moved their primary residence from high-tax to low-tax states. The rationale is clear: targeting those with higher incomes is more likely to yield substantial revenue for the state.
AI isn’t the only tool being used; human auditors are also examining cellphone records to determine taxpayers’ primary locations. This data is crucial in establishing where individuals spend most of their time and, consequently, where they owe taxes. The aggressive approach taken by New York has raised questions about the complexities of tax residency, especially for those who maintain residences in multiple states.
The issue of tax residency isn’t limited to the United States. International celebrities have faced similar challenges, with Shakira being a high-profile example. Accused of failing to pay taxes in Spain while claiming residency in the Bahamas, she was fined heavily for her alleged misstep.
As states like New York continue to refine their methods for identifying changes in tax residency, it’s clear that AI will play an increasingly significant role. The advent of tax residency certificates in Cyprus and similar documentation elsewhere underscores the growing importance of accurately establishing one’s tax residency in an interconnected world.
