Legal Maneuvers Surrounding Auditor General’s Position
In a significant development reported by the Cyprus News Agency, the Attorney General’s legal team is making final adjustments to a document that could alter the landscape of Cyprus’s legal framework. The Supreme Constitutional Court is poised to receive a suspension request for the Auditor General, with the submission anticipated around noon today.
Christos Clerides, a prominent figure in the Attorney General’s legal team, conveyed to reporters that there is a keen interest in having the core of the issue adjudicated. “We want everything to be examined within the context of the substance,” he emphasized, signaling a desire for thorough scrutiny.
The crux of the matter revolves around allegations that the Auditor General has overstepped his boundaries. However, Clerides pointed out that such actions do not inherently equate to misconduct. “
Clerides reminded that the judicial system itself has mechanisms for addressing overreach. He cited Article 139 of the Constitution, which allows for an organ of the state to challenge another’s authority before the Supreme Court, now known as the Supreme Constitutional Court.
Addressing concerns about unilateral decisions by the Auditor General, Clerides noted that an Audit Service and a five-member council are involved in decision-making processes, often reaching consensus.
The case echoes past instances where attempts were made to suspend high-ranking officials, including judges and even a former Deputy Attorney General. Clerides referenced the Trifonos case, where it was established that only the President holds the exclusive authority to initiate suspension proceedings against an independent official.
