Foreclosure Hearing for Monastery Delayed
In a recent development at the Nicosia District Court, the hearing to cancel foreclosure orders for the Monastery of Sant Habakkuk’s €807,000 has been deferred. The monks of the monastery, who are at the center of this legal tussle, will have to wait until May 30 for their case to be heard. This scheduling change was necessitated to broaden the scope of the legal process.
The postponement was granted to ensure that the legal proceedings are inclusive of all relevant parties. In addition to the Legal Service and MOKAS, who were already served, the court has now extended the requirement to serve the request to three more parties: the Hellenic Bank, the Bank of Cyprus, and the Land Registry. This move is aimed at maintaining a comprehensive legal approach, ensuring that all entities with a potential interest in the matter are represented and have the opportunity to respond.
At the heart of the proceedings is Bishop Isaiah of Tamasos, who is personally involved and represented by lawyer Elias Stefanou. The complexity of the case is heightened by claims from two citizens who assert ownership of the contested money. Their involvement adds another layer to the proceedings, which the court is meticulously navigating.
The court has stipulated that any objections to the monks’ request should be presented within an eight-day window prior to the rescheduled hearing date. This tight deadline underscores the urgency with which the court is treating the matter, balancing thoroughness with efficiency.
