Legal Proceedings Underway for Auditor General’s Suspension
In a significant legal development, the Attorney General’s legal team is preparing to file a request with the Supreme Constitutional Court for the suspension of the Auditor General. The Cyprus News Agency has reported that the final touches are being made to the request, which is anticipated to be lodged around midday.
Attorney Christos Clerides, part of the Attorney General’s legal team, conveyed to the Cyprus News Agency their intention to focus on the substance of the issue. The request is based on the complaint that the Auditor General exceeded his powers, which Clerides emphasized, “does not constitute inappropriate behavior.”
Clerides elaborated on the constitutional mechanisms in place for such disputes, citing Article 139, which allows for a Supreme Court review when one state organ challenges another’s authority. He clarified that jurisdictional issues are distinct from inappropriate behavior, which implies unfitness for office.
He further explained that the Auditor General’s decisions are not made in isolation but with the support of an Audit Service and a five-member council. Clerides posed a rhetorical question about the potential dissolution of the Audit Service due to unpopular decisions, highlighting the complexity of such administrative actions.
The case recalls past attempts to suspend high-ranking officials, including judges and the former Deputy Attorney General, Rikkos Erotokritou. Clerides referenced the Trifonos case, where it was determined that only the President has the authority to initiate suspension proceedings against independent officials.
With this backdrop, questions arise about whether the Attorney General and Deputy Attorney General require presidential approval to proceed. Clerides pointed out that, based on precedent, initiating such a procedure is within the President’s purview.
